Welcome to MyBoone.app (“the Website” or “the App”), operated by Boone App Ltd (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the Website, App, and all associated services (the “Services”). By creating an account, accessing, or using MyBoone.app, you confirm that you accept and agree to comply with these Terms. If you do not agree, you must stop using the Website and App immediately. These Terms are supplemented by the following policies, which collectively govern your use of MyBoone.app:

1.1 Website and App: Refers to MyBoone.app and all associated features, services, and applications provided by Boone App Ltd.

1.2 User: Any individual or entity accessing or using the Website, App, or associated services.

1.3 Content: All text, images, graphics, software, code, data, and other materials made available on the Website or App.

1.4 Account: A personal account created by a user to access specific features of MyBoone.app.

1.5 User-Generated Content: Any data, text, images, or submissions uploaded or shared by users within the App, including food images, dietary entries and related inputs.

1.6 Third-Party Services: External platforms, tools, or content integrated into MyBoone.app, such as supermarket or health app integrations.

1.7 Paid Features: Additional services or features offered for a fee, such as premium features, subscriptions, or advanced analytics.

1.8 Genetic Services: Optional features involving the processing of genetic data (including VCF files) to provide nutrigenetic insights, which require separate explicit consent as described in the Privacy Policy.

1.9 Force Majeure: Any event beyond Boone App Ltd’s reasonable control, such as natural disasters, cyberattacks, or government actions, that affects the provision of services.

2.1 You must be at least 16 years old to create an account or use MyBoone.app independently.

2.2 If you are under 16, a parent or legal guardian must create and manage the account on your behalf and must provide any required consents. Where genetic services are used for a person under 16, a parent or legal guardian must provide explicit consent.

2.3 By using MyBoone.app, you confirm that you have the legal capacity to agree to these Terms (or that a parent/guardian is agreeing on your behalf where applicable).

2.4 Access to MyBoone.app is prohibited in jurisdictions where its use violates applicable laws. It is your responsibility to ensure compliance with local regulations.

3. User Accounts

3.1 Account Creation: To access certain features, you must provide accurate, complete, and up-to-date information during registration. Providing false or misleading information may result in account suspension or termination.

3.2 Account Security: You are responsible for safeguarding your login credentials and any activity conducted under your account. Notify us immediately at hello@myboone.app if you suspect unauthorised access.

3.3 Account Usage: Each account is intended for individual use unless we provide a feature that supports managed profiles (e.g., family profiles). You are responsible for activity within your account.

3.4 Inactive Accounts: If your account remains inactive for an extended period (12 months or more), we may deactivate your account. We may provide notice via email where feasible.

3.5 Account Termination: We may suspend or terminate accounts for breaches of these Terms, violations of the App Usage Policy, or engagement in fraudulent or illegal activities.

4. Acceptable Use

4.1 You agree to use MyBoone.app in compliance with these Terms and the App Usage Policy.

4.2 Prohibited Activities: You must not:

  • Enter false, misleading, or deliberately incomplete data.
  • Use automated tools, bots, or scripts to access or interact with the Services in a way that interferes with normal operation.
  • Exploit vulnerabilities, reverse engineer, or attempt to bypass security controls.
  • Upload unlawful, harmful, or infringing content.
  • Attempt to scrape, mine, or extract data from the Services for external commercial purposes without our permission.

4.3 Data Accuracy: You are responsible for the accuracy of the information you submit. Boone App Ltd is not liable for outcomes resulting from incomplete or inaccurate inputs.

5. Services and Features

5.1 MyBoone.app provides nutrition insights, analytics, and personalised recommendations based on user-provided information and AI-driven analysis.

5.2 No Guarantees: While we aim to provide helpful and accurate insights, we do not guarantee that outputs will be error-free, complete, or suitable for every purpose.

5.3 Third-Party Integrations: Certain features may involve integrations with third-party services. We are not responsible for third-party services, and your use of them may be subject to separate terms.

5.4 Service Modifications: We may introduce, modify, or discontinue features at any time. We may notify you of significant changes via email or in-app notifications where appropriate.

5.5 Beta Features: Some features may be offered as beta. Beta features may change, be discontinued, or contain errors. You use beta features at your own risk.

6. Promotions, Offers, and Discounts

Promotions, referral incentives, free trials, and discounts may be offered from time to time and will be subject to any additional terms presented at the time of the offer.

7. Refund Policy

7.1 Refunds apply only to paid features purchased directly through MyBoone.app, unless otherwise required by law.7.2 Where a refund right applies, you may request a refund by contacting hello@myboone.app within 14 days of purchase. If your purchase was made via Apple App Store or Google Play, refund requests must be directed to that platform.

8. Data, AI, and Privacy

8.1 Boone App Ltd collects and processes personal data in accordance with its Privacy Policy.

8.2 AI and Profiling: The Services use artificial intelligence and statistical modelling to analyse the information you provide (including food images and dietary entries) and to generate personalised nutrition insights. This may include profiling based on dietary and behavioural patterns.

8.3 Model Improvement: Data may be pseudonymised and used internally to develop, test, train and improve our algorithms and Services.

8.4 Structured Datasets: Boone may create structured datasets derived from user activity for research, analytics and commercial licensing purposes. These datasets do not include direct identifiers such as your name or contact details.

8.5 Genetic Services: Genetic services are optional and require separate explicit consent. Genetic data handling is described in the Privacy Policy.

9. Cookies and Tracking Technologies

We use cookies and similar technologies as described in our Cookie Policy.

10. Health and Nutritional Disclaimers

10.1 The Services provide informational insights and do not constitute medical advice, diagnosis, or treatment.

11. Service Availability and Updates

We aim to make the Services available, but we do not guarantee uninterrupted access. We may perform maintenance or make changes to the Services.

12. Intellectual Property

All intellectual property rights in the Website, App, and its Content are owned by or licensed to Boone App Ltd. You are granted a limited, revocable, non-exclusive licence to use the Services for personal, non-commercial purposes.

13. Limitation of Liability

To the extent permitted by law, Boone App Ltd is not liable for indirect, incidental, or consequential losses arising from your use of the Services. Nothing in these Terms excludes liability for fraud, or for death or personal injury caused by negligence.

14. Force Majeure

Boone App Ltd is not liable for delays or failure to perform obligations due to events beyond its reasonable control.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales. Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
